July 18, 2019
Attorneys: Krista L. Kulp, Irving E. Walker and David S. Gold
This program will focus on the interplay between intellectual property rights and the Bankruptcy Code from a functional, goal-oriented perspective. More specifically, this program will cover the rights of debtors and creditors with respect to copyrights, patents, trademarks, and trade secrets, and focus on how those parties can protect and maximize the value of their intellectual property rights in the framework of an ongoing chapter 11 case. In addition, this program will briefly summarize the facts and legal issues in Mission Product Holdings Inc. v. Tempnology, LLC, which was recently decided by the Supreme Court, and will examine the Supreme Court’s decision and its practical implications for debtors and trademark licensees.
